LMK Terms of Service
Effective Date: October 7, 2026

These Terms of Service (“Terms”) govern your access to and use of LMK, including the LMK mobile application, website, services, features, and functionality (collectively, the “Service”).
The Service is operated by LMK Social Inc. (“LMK,” “we,” “us,” or “our”).
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree to these Terms, you may not use the Service.


1. Eligibility
You must be at least 13 years old to create or use an LMK account.
By using LMK, you represent that you meet the applicable minimum age requirement and that the information you provide to LMK is accurate and complete.
You must provide accurate information when creating your account, including your full legal name, date of birth, email address, and phone number.
You may not create an account for another person without authorization, impersonate another person, or provide false information for the purpose of creating or maintaining an account.
LMK may take reasonable steps to verify age, identity, contact information, or other account information where necessary for safety, security, legal compliance, or operation of the Service.

 

2. Your LMK Account
Your LMK account is personal to you.
You are responsible for maintaining the security of your account and for activity occurring through your account. You must notify LMK if you believe your account has been accessed or compromised without authorization.
LMK may require verification of your email address, phone number, or other account information.
You may create or access your account using email and password authentication or a supported third-party authentication provider. When you use a third-party authentication provider, that provider's terms and privacy practices may also apply.

 

3. Groups and Events
LMK allows users to create and participate in Groups and Events.
A Group is an ongoing space that may be used by friends, families, communities, organizations, clubs, teams, or other groups of people.
An Event is an individual gathering that may exist independently or be associated with a Group.
Groups may host multiple Events, and each Event may have its own guest list, invitations, RSVP status, privacy settings, and participation requirements.
Group administrators and Event hosts may have controls over visibility, discoverability, joining, guest lists, and other aspects of their Groups or Events.
By joining or participating in a Group or Event, you agree to comply with applicable settings established by its administrator or host, as well as these Terms and the Community Guidelines.
LMK does not guarantee the identity, conduct, safety, reliability, legality, or accuracy of any user, Group, Event, host, administrator, member, guest, or User Content.

 

4. Invitations, Contacts, and Guest Lists
LMK may allow users to invite people to Groups and Events using information such as names, email addresses, or phone numbers.
You may add contacts to LMK either by giving LMK permission to access contacts stored on your device or by manually entering information for individual contacts.
You are responsible for ensuring that your use of another person's information through LMK is lawful and appropriate.
An LMK Contact is a person with whom you are connected on LMK. Becoming someone's LMK Contact does not automatically give either person access to the other's private phone number or email address.
Phone numbers and email addresses are private by default and are not automatically displayed simply because two people are Contacts, members of the same Group, guests at the same Event, or otherwise connected through LMK.
Users may have control over whether their name appears on applicable guest lists. Group administrators and Event hosts may also control whether member or guest lists are visible or hidden.
Where a user's name is hidden from a guest list, their participation may still be reflected in an aggregate guest count.
Where an Event permits plus-ones, the privacy and visibility of a plus-one may initially be associated with the person through whom the plus-one was invited. If the plus-one subsequently creates or joins an LMK account, the plus-one's own account settings may apply.

 

5. Privacy
Your use of LMK is also governed by the LMK Privacy Policy, which explains how LMK collects, uses, discloses, retains, and protects personal information.
The Privacy Policy forms part of these Terms.

 

6. User Content
LMK allows users to create, upload, post, display, and otherwise provide content through the Service (“User Content”).
User Content may include photographs, text, comments, polls, announcements, questions, profile information, social links, documents, and other material supported by the Service.
You retain ownership of your User Content.
By submitting User Content to LMK, you grant LMK a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transmit, display, distribute, and otherwise process that User Content to the extent reasonably necessary to provide, operate, maintain, secure, and improve the Service.
This licence does not transfer ownership of your User Content to LMK.
You represent that you have the rights and permissions necessary to submit your User Content and grant LMK the rights described above.
You are responsible for the User Content you submit.

 

7. Visibility of User Content
Content posted within a Group or Event may be visible to other members or guests depending on the applicable privacy and visibility settings.
You should not post information that you do not want other authorized members or guests to see.
LMK cannot guarantee that content shared with other users will remain confidential. Other users may be able to download, screenshot, copy, save, or otherwise record content they are permitted to access.
Users may not copy, distribute, publish, or otherwise use another person's content in a manner that violates that person's rights, applicable law, or these Terms.

 

8. External Social Accounts
LMK may allow users to add links to external services such as Instagram, TikTok, LinkedIn, or personal websites to their LMK profiles.
These services are operated independently of LMK. LMK is not responsible for their content, availability, security, privacy practices, or terms.

 

9. Acceptable Use
You may use LMK only for lawful purposes and in accordance with these Terms and the Community Guidelines.
You may not:

  • Harass, threaten, stalk, intimidate, or abuse another person;

  • Engage in hate speech or discriminatory conduct;

  • Impersonate another person or organization;

  • Defraud, scam, or deceive other users;

  • Publish or distribute another person's private information without authorization;

  • Use LMK to facilitate illegal activity;

  • Upload malicious code or attempt to compromise the Service;

  • Interfere with the operation or security of LMK;

  • Circumvent access controls or privacy settings;

  • Create accounts for deceptive or abusive purposes;

  • Scrape or collect information from LMK through unauthorized automated means;

  • Infringe copyright, trademark, privacy, publicity, or other rights;

  • Upload content that violates the Community Guidelines;

  • Send unauthorized commercial communications or spam through the Service; or

  • Attempt to exploit, harm, manipulate, or deceive other users.

 

10. Moderation and Enforcement
LMK may review, investigate, restrict, remove, or disable User Content or accounts where reasonably necessary to operate and protect the Service.
LMK may take action where it reasonably believes that content or conduct:

  • Violates these Terms or the Community Guidelines;

  • Violates applicable law;

  • Creates a safety or security risk;

  • Harms another person;

  • Threatens the integrity of the Service; or

  • Creates legal or regulatory risk for LMK.

Depending on the circumstances, LMK may remove content, limit functionality, restrict access, suspend an account, or permanently terminate an account.
LMK may take action without prior notice where reasonably necessary to protect users, LMK, third parties, or the Service.
Users may contact LMK regarding enforcement decisions through the available support or contact channels. LMK does not guarantee that content will be restored or that an account will be reinstated.

 

11. Intellectual Property
The Service and its underlying software, design, branding, logos, interfaces, graphics, text, features, and other materials provided by LMK are owned by or licensed to LMK and are protected by applicable intellectual-property laws.
Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, license, reverse engineer, or create derivative works from the Service or LMK's proprietary materials.
The LMK name, trademarks, logos, and branding may not be used without authorization.

 

12. Feedback
If you provide suggestions, ideas, recommendations, or feedback concerning LMK, you grant LMK the right to use that feedback without restriction or compensation to you.

 

13. Third-Party Services
The Service may integrate with or depend upon third-party services, including authentication providers, hosting providers, communications providers, analytics providers, security providers, payment providers, and other technology services.
LMK does not control third-party services and is not responsible for their independent operation, content, availability, security, or privacy practices.
Your use of third-party services may be subject to their own terms and policies.

 

14. Service Availability and Changes
LMK may modify, suspend, or discontinue any portion of the Service at any time.
LMK does not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
Features may be added, removed, or changed as LMK develops and improves the Service.

 

15. Payments and Commercial Features
LMK may introduce paid features, subscriptions, purchases, advertising, sponsored content, or other commercial offerings.
Where paid services are introduced, additional terms, pricing, renewal, cancellation, and payment conditions may apply.

 

16. Account Termination
You may stop using LMK at any time and may request deletion of your account through available LMK functionality.
LMK may suspend or terminate accounts in accordance with these Terms.
Termination does not eliminate rights or obligations that by their nature should survive termination, including provisions concerning intellectual property, User Content, liability, disputes, and enforcement.

 

17. Disclaimer
To the maximum extent permitted by applicable law, the Service is provided on an “as available” and “as is” basis.
LMK does not warrant that the Service will satisfy every user's requirements or operate without interruption, errors, or security incidents.
LMK does not endorse or guarantee the identity, conduct, safety, reliability, legality, or accuracy of any user, Group, Event, post, invitation, or other User Content.
You are responsible for exercising appropriate judgment when interacting with other users or participating in Groups and Events.
Nothing in these Terms excludes or limits rights or remedies that cannot legally be excluded or limited under applicable law.

 

18. Limitation of Liability
To the maximum extent permitted by applicable law, LMK and its directors, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Service.
To the maximum extent permitted by applicable law, LMK's aggregate liability arising from your use of the Service will be limited to the greater of the amount you paid to LMK for the Service during the twelve months preceding the event giving rise to the claim and CAD $100.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

 

19. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless LMK and its directors, officers, employees, and affiliates from claims, losses, liabilities, damages, and expenses arising from your User Content, misuse of the Service, violation of these Terms, violation of another person's rights, or violation of applicable law.

 

20. Governing Law and Disputes
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles, except to the extent that mandatory laws of the jurisdiction in which you reside apply.
Nothing in these Terms is intended to deprive consumers of mandatory rights or protections available under the laws of their jurisdiction.

 

21. Changes to These Terms
LMK may update these Terms as the Service develops or as required by law.
Where changes are material, LMK will provide reasonable notice through the Service or another appropriate method.
Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by applicable law.
